Terms of Use

1. Agreement to Terms

By accessing or using aigain.pro, its subdomains, or any products and services offered by AVITA-PL sp. z o.o. — including products sold through the Whop platform — you agree to be bound by these Terms of Use.

2. Description of Services

AIGain.pro provides:

• AI Consulting & Strategy — analysis and roadmap development for AI and automation implementation
• AI Agents & Chatbots — development and deployment of intelligent virtual assistants
• RPA & Process Automation — robotic process automation solutions using n8n, Make.com, and similar tools
• Content Automation — AI-powered content generation systems
• AI Voice Bots — voice-based AI solutions for customer service and lead generation
• Sales & Lead Generation Automation — end-to-end automated sales funnel setup
• Digital Products — courses, templates, guides, automation workflows, and AI tool bundles distributed via Whop

3. Eligibility

To use our Service, you must:

• Be at least 18 years of age
• Have the legal capacity to enter into a binding contract
• Not be located in a country subject to international sanctions
• Not be prohibited from using the Service under applicable laws

4. Account Registration

Some features require account registration via Whop. You agree to provide accurate information, maintain account security, notify us of unauthorized access, and take responsibility for all activities under your account.

5. Intellectual Property

All content on aigain.pro is the property of AVITA-PL sp. z o.o. or its licensors, protected by copyright and trademark law.

• Custom-built solutions created specifically for a client become the client's property upon full payment
• Templates and proprietary frameworks used in delivery remain our property and are licensed (not sold) on a non-exclusive basis
• Digital products purchased via Whop are licensed for personal or internal business use only — not for resale or redistribution without written permission

You may not copy, reverse engineer, or use our branding without prior written approval.

6. Client Obligations

• Provide timely access to required systems, credentials, and data
• Review and approve deliverables within agreed timeframes
• Pay invoices in accordance with agreed payment terms
• Not use services or deliverables for illegal, harmful, or unethical purposes
• Maintain confidentiality of any proprietary methodologies shared

7. Payment Terms

• Prices quoted in EUR unless otherwise specified, exclusive of VAT
• Project-based services: Typically 50% upfront deposit, 50% upon completion
• Retainer/subscription services: Billed monthly in advance
• Digital products (Whop): Full payment at checkout

Late invoices are subject to statutory interest under Polish law. We reserve the right to suspend services for overdue accounts.

8. Confidentiality

Both parties agree to keep confidential all non-public information received during the engagement. This obligation survives termination for 3 years.

9. Prohibited Uses

You agree not to use the Service to violate laws, transmit spam or malware, engage in fraudulent activities, infringe intellectual property rights, harass users, attempt unauthorized access, or build competing products using our proprietary methodologies.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND. We do not warrant that results achieved for other clients will be replicated for your business. AI tools and automation systems involve inherent uncertainty.

11. Limitation of Liability

Our total liability for any claims shall not exceed the total fees paid by you in the 3 months preceding the claim. We are not liable for indirect, incidental, special, punitive, or consequential damages. Nothing in these Terms limits our liability for death or personal injury caused by negligence or fraud.

12. Indemnification

You agree to indemnify and hold harmless AVITA-PL sp. z o.o. from any claims, damages, and expenses arising from your violation of these Terms, your use of the Service in violation of applicable law, or your negligence or willful misconduct.

13. Term and Termination

These Terms remain in effect for as long as you use the Service. We may suspend or terminate your access immediately if you breach these Terms, fail to pay invoices, or engage in illegal conduct. Provisions regarding confidentiality, intellectual property, liability, and indemnification survive termination.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of Poland. Disputes are subject to the exclusive jurisdiction of the courts in Rzeszów, Poland. EU consumers may also use the ODR platform: ec.europa.eu/consumers/odr.

15. Third-Party Services

Our Service integrates with Whop, Stripe, n8n, Make.com, OpenAI, and others. Use of those platforms is subject to their own terms of service. We are not responsible for the availability or actions of third-party services.

16. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice by posting the updated Terms with a revised date and, for material changes affecting active clients, by email notification. Continued use constitutes acceptance.
